Welcome to Vibe. These Terms and Conditions form a binding agreement between you and Vibe regarding your use of our app and services. By creating an account, accessing, or using Vibe, you agree to these Terms and to our Privacy Policy.

1. Eligibility and Account

• You must be at least 18 years old to use Vibe.
• You agree to provide accurate information and to keep your account secure. You are responsible for activity that occurs under your account.
• We may disable or terminate accounts that violate these Terms or applicable laws.

2. User Content and License

You may upload content such as photos, videos, a bio, and other profile details. You retain ownership of your content. You grant Vibe a worldwide, non exclusive, royalty free license to host, display, reproduce, and distribute your content within the app for the purpose of operating and improving Vibe. This license ends when your content is deleted from our systems.

3. Community Guidelines

To keep Vibe safe and respectful, you agree not to:

• Harass, bully, threaten, or discriminate against others.
• Post illegal, explicit, or non consensual content.
• Impersonate another person or misrepresent your identity or age.
• Use the service for spam, scams, or commercial solicitation without our written permission.
• Probe or disrupt the app, its systems, or users.

We may remove content or take action on accounts that violate these rules.

4. Matches, Messaging, and Safety

Vibe helps you discover and chat with other people. We do not perform criminal background checks and we do not guarantee the identity or intentions of any user. Please use common sense and follow safety practices when interacting with others online or in person. You are solely responsible for your interactions.

5. Location, Notifications, and Devices

Some features require access to device services such as location and push notifications. By enabling these features you consent to their use to provide functionality like showing nearby matches and sending alerts.

6. Subscriptions, In App Purchases, and Refunds

• Vibe may offer paid features or subscriptions. Prices and terms are shown at purchase time.
• Purchases made through the Apple App Store or Google Play are billed and managed by those platforms. Any refunds are handled by the platform according to its policies.
• Subscriptions renew automatically unless you cancel at least 24 hours before the renewal date in your platform account settings.

7. Intellectual Property

Vibe and its logos, designs, and software are owned by us or our licensors and are protected by law. You may not copy, modify, reverse engineer, or create derivative works from our app or content except as allowed by law.

8. Third Party Services

Vibe may link to or integrate with third party services. We are not responsible for those services or their content. Your use of third party services is governed by their terms and privacy policies.

9. Termination

You may stop using Vibe at any time and can request account deletion in the app. We may suspend or terminate your access if you violate these Terms or if we need to protect the service or our users.

10. Disclaimers

Vibe is provided on an as is and as available basis. We do not promise uninterrupted or error free service, and we do not guarantee that you will obtain matches or any specific outcomes. To the fullest extent allowed by law, we disclaim all warranties, express or implied.

11. Limitation of Liability

To the fullest extent allowed by law, Vibe and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or profits, arising from your use of the service. Our total liability for any claim will not exceed the amount you paid to Vibe in the twelve months before the claim arose.

12. Indemnification

You agree to defend, indemnify, and hold harmless Vibe and its affiliates from any claims, liabilities, damages, losses, and expenses arising from your use of the service or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law rules. Any dispute will be resolved through binding arbitration on an individual basis, and you waive any right to participate in a class action. You and Vibe agree to the exclusive jurisdiction and venue of state or federal courts located in Minnesota for matters that are not subject to arbitration.

14. Changes to These Terms

We may update these Terms to reflect changes in our services or legal requirements. When we post changes, we will update the Effective Date above. Continued use of Vibe after changes means you accept the updated Terms.
